OVERVIEW

This website is operated by Vibn Inc. Throughout these Terms, the words "we", "us", "our" and "Vibn" refer to Vibn Inc. By visiting our website at shopvibn.com and/or purchasing from us, you agree to be bound by the following Terms of Service. Please read them carefully before placing an order.

If you do not agree to these Terms, you may not access or use our website.

SECTION 1 — ABOUT VIBN

Vibn Inc. is a Canadian-based e-commerce brand specializing in curated vintage mystery boxes. All garments sold by Vibn are pre-owned, second-hand vintage clothing. Items are not sold as new. By purchasing from Vibn, you acknowledge that you are purchasing pre-owned vintage garments with characteristics consistent with age and prior use.

SECTION 2 — MYSTERY BOX PURCHASES

This section is critical. Please read it fully before placing an order.

2.1 Random Selection All mystery boxes sold by Vibn are hand-curated at random by our team at the time of purchase. Boxes are not pre-packed. By completing a purchase you acknowledge and agree that:

  • Item selection is entirely random within your chosen size category
  • No specific brands, items, colours, styles, or graphics are guaranteed
  • Any brands or items shown in advertisements, social media content, videos, images, or any other marketing material are examples only and do not represent or guarantee the contents of your specific order
  • Personal preference, brand preference, style preference, or subjective dissatisfaction with the random selection received does not constitute a fault, misrepresentation, or grounds for a return, refund, or dispute

2.2 No Brand Guarantee The appearance of any brand name — including but not limited to Nike, Carhartt, The North Face, Adidas, Champion, Stussy, Harley Davidson, or any other brand — in our advertising, website content, social media posts, videos, or product images does not guarantee that such brands will be included in your order. Brand availability varies by drop and changes without notice. No claim of false advertising or misrepresentation can be made based on brands shown in marketing materials not appearing in a customer's order.

2.3 Marketing and Advertising Disclaimer All images, videos, flat lays, unboxing content, and advertising materials produced by Vibn or on behalf of Vibn are for illustrative purposes only. They showcase examples of items that have appeared or may appear in mystery boxes and are not a representation of what any specific customer will receive. By purchasing, you confirm that you have not made your purchase based on any expectation of receiving specific items, brands, or pieces shown in any marketing material.

SECTION 3 — PRODUCT CONDITION

3.1 Vintage Grade A Condition All garments sold by Vibn are pre-owned vintage clothing graded as Grade A. Grade A vintage is defined as garments in good wearable condition that may show the following characteristics inherent to pre-owned vintage clothing:

  • Minor fading or colour variation
  • Light fabric wear or pilling
  • Softened or distressed materials
  • Small marks, imperfections, or age-related features
  • Variations in print quality consistent with age

These characteristics are a natural and expected part of vintage clothing. They do not constitute defects, faults, damage, or grounds for a return, refund, or dispute.

3.2 Quality Assurance All garments pass through a quality assurance process prior to dispatch including condition checks and final inspection. Garments that are deemed unwearable due to significant damage are removed from inventory prior to packing.

SECTION 4 — SIZING

As all garments are pre-owned vintage, customers acknowledge and agree that:

  • Original size tags may be missing
  • Garments may have shrunk or stretched over time due to prior washing or wear
  • Vintage sizing standards differ from modern sizing standards
  • Era-specific cuts and fits differ from contemporary cuts

Differences in fit due to vintage sizing, era-specific cuts, or natural changes to the garment over time do not constitute incorrect sizing and are not grounds for a return or refund. We recommend sizing up where unsure.

SECTION 5 — RETURNS AND REFUNDS

5.1 All Sales Final All mystery box sales are final. Due to the random, hand-curated, and custom nature of each order, we do not accept returns or offer refunds for any of the following reasons:

  • Dissatisfaction with the random item selection received
  • Absence of a specific brand, item, colour, or style
  • Personal taste or style preference
  • Minor condition characteristics consistent with Grade A vintage clothing as defined in Section 3
  • Sizing differences consistent with vintage garments as described in Section 4
  • Items shown in marketing materials not appearing in the order

5.2 Eligible Returns A return or refund will only be considered under the following specific circumstances:

  • An item received contains significant damage beyond reasonable vintage wear, defined as large tears, extensive holes, or structural damage that renders the garment entirely unwearable
  • An item received is materially and significantly different in size from the size category ordered, beyond normal vintage sizing variation as described in Section 4

To request an eligible return, customers must contact us at info@shopvibn.com within 7 days of delivery with photographic evidence. Returns will not be accepted without prior written authorization from Vibn. The cost of return shipping for non-faulty items is the responsibility of the customer.

5.3 Canadian Consumer Rights Nothing in these Terms limits or excludes any rights you may have under applicable Canadian consumer protection legislation that cannot be excluded by contract.

5.4 European Union Right of Withdrawal

If you are a consumer located in the European Union, you may have a statutory right to withdraw from your purchase within 14 days of receiving your order, where required by applicable EU consumer protection law.

Mystery box purchases remain final sale except where mandatory consumer law gives you a right of withdrawal. Nothing in these Terms limits or excludes any EU consumer rights that cannot be limited or excluded by contract.

To exercise your EU right of withdrawal, you must submit a withdrawal request through our EU Right of Withdrawal form or contact us at info@shopvibn.com within 14 days of receiving your order. Your request must include your name, order number, email address, and the item or items you wish to withdraw from.

If you exercise your EU right of withdrawal, you are responsible for the direct cost of returning the goods to us unless we are required by law to cover those costs. Returned items must be sent back within 14 days after you notify us of your withdrawal. We recommend using a tracked shipping method, as we are not responsible for returned items lost in transit.

We may withhold reimbursement until we have received the returned goods or until you have provided proof that the goods have been sent back, whichever occurs first.

Goods must be returned in the same condition in which they were received. You may be responsible for any reduction in value caused by handling the goods beyond what is necessary to inspect them.

SECTION 6 — ORDER CANCELLATIONS AND MODIFICATIONS

6.1 No Cancellations All mystery box orders are sold at promotional pricing. All sales are final and orders cannot be cancelled once submitted. Because each box is hand-sourced and individually prepared for your order, our fulfilment process begins immediately after checkout. Cancellations are not accepted under any circumstances after an order has been placed, including in cases of processing or shipping delays. This cancellation policy does not limit any mandatory consumer rights that may apply by law, including any eligible EU right of withdrawal.

6.2 Order Modifications Address changes or size modifications may be requested by emailing info@shopvibn.com as soon as possible after placing your order. Modification requests will be accommodated where possible provided your order has not yet been dispatched. We cannot guarantee all modification requests can be fulfilled.

SECTION 7 — PROCESSING AND DISPATCH TIMES

All mystery boxes are hand-picked and individually curated to order. As products are not pre-packed, dispatch times are longer than standard retail operations.

  • Canadian orders: Typically dispatched within 5–10 business days
  • US orders: Typically dispatched within 5–10 business days
  • International orders: Typically dispatched within 10–15 business days with delivery taking 3–5 weeks

These timeframes are estimates and may vary depending on order volume, seasonal demand, operational capacity, courier processing, or other factors outside our reasonable control. Dispatch within these stated timeframes does not constitute delay or grounds for cancellation or refund.

Tracking information will be provided where available. A courier status of "Expecting Parcel" or similar indicates the order has been prepared and is awaiting courier collection. Temporary delays between label generation and courier scanning are normal and do not indicate loss or non-fulfilment.

International orders may be subject to import duties, customs fees, or local taxes imposed by the destination country. These charges are the sole responsibility of the buyer. For EU withdrawal returns, customers are responsible for the direct cost of return shipping unless otherwise required by applicable law.

SECTION 8 — PAYMENT DISPUTES AND CHARGEBACKS

By completing a purchase you agree to contact Vibn directly at info@shopvibn.com to resolve any concern before initiating a chargeback or payment dispute with your financial institution.

The following do not constitute valid grounds for a chargeback or payment dispute:

  • Random mystery box selection not meeting personal brand or style expectations
  • Absence of specific brands shown in marketing materials
  • Vintage condition characteristics as defined in Section 3
  • Sizing variation inherent to pre-owned vintage garments as described in Section 4
  • Dispatch within the stated processing timeframes in Section 7

Vibn reserves the right to provide all order records, policy acknowledgements, marketing disclaimers, tracking records, delivery confirmations, and customer communications as evidence in response to any dispute or chargeback filed.

SECTION 9 — PRICING AND PROMOTIONS

All prices are listed in Canadian dollars unless otherwise stated. Prices are subject to change without notice. Promotional offers, free item inclusions, and sale pricing are available for a limited time only and may be withdrawn at any time without notice. The inclusion of promotional items such as free bonus pieces is subject to availability and applies only during the active promotional period.

SECTION 10 — INTELLECTUAL PROPERTY

All content on shopvibn.com including images, videos, graphics, text, and branding is the property of Vibn Inc. and may not be reproduced, distributed, or used without express written permission.

SECTION 11 — LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Vibn Inc., its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your purchase or use of our products or website. Our total liability to you shall not exceed the amount paid for the order in question.

SECTION 12 — GOVERNING LAW

These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.

SECTION 13 — CHANGES TO TERMS

We reserve the right to update or replace these Terms at any time by posting the updated version to shopvibn.com. Your continued use of the website following any changes constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.
